AGV SPORTS GROUP WARRANTY POLICY:
Every AGV Sports product features a one-year warranty from its purchase date to the original buyer for manufacture defects. A product recognized as defective by AGV Sports Group will be repaired or replaced at AGV Sports Group’s discretion.
You must establish proof of purchase to obtain warranty service or replacement. AGV Sports Group will only give product warranties when the product has been purchased from an authorized AGV Sport dealer.
Certain authorized retailers do sell our products online, or through online auction sites, when in accordance with our regulations. In order for the warranty to apply to online purchases, an itemized receipt from that dealer must be included.
If you are not sure if the seller is an authorized AGV Sport dealer, please contact the seller and request the business name, physical address, and phone number. To verify if the seller is an authorized dealer, please contact our customer service. If the seller does not provide this information, then our warranty does not apply to this product.
This warranty is expressly in lieu of all other warranties. Any implied warranties of merchantability or fitness for a particular purpose are limited to the same duration as this express warranty.
AGV Sports Group is not liable for any incidental or consequential damages. This warranty does not cover any representation or warranty made by a dealer beyond the provisions of this warranty.
The AGV Sports Group warranty does not cover:
1. Products without an invoice or sales receipt, which makes it impossible to establish the date and origin of sale, and also due to the risk of illegal or illicit provenance (e.g. stolen, etc.).
2. Products that have reached the end of their normal life cycle.
3. Damage due to accidents, negligence, misuse, corrosion, incorrect installation, improperly performed repairs, use of incompatible spare parts or components, unapproved modifications, or normal wear and tear.
4. Consumable materials including knee pucks, armor padding, etc.
5. Products purchased outside of.
6. Any expenditure related to the transport of the product to and from an authorized service center.
7. Compensation for the inconvenience associated with not being able to use the product while being repaired or replaced.
At AGV Sport, we can provide product repairs and/or refurbishment services. For example, if the suit has been damaged in a crash, we may be able to restore it to a near-original look. If your product is under warranty, we will carry out a full examination of the product. If it is found to be faulty due to original manufacture, we will repair or replace the garment at our discretion.
If your warranty is expired, we will still be glad to refurbish your garments for the appropriate cost including shipping and handling charges. If you have any questions or concerns please fill the form below.
Terms for Custom-Measured Road-Race Suits
1) Custom Goods – No Returns or Refunds
Each road-race suit is custom-made to the rider’s unique body measurements and specifications. Because these are bespoke goods that cannot be resold or repurposed, all sales are final. Except where required by law, no returns, cancellations, or refunds are permitted once production has begun.
2) Fit & Alterations Policy (Exclusive Remedy)
We provide a fit process and will perform reasonable alterations to address fit issues consistent with the original design and safety intent.
- Alteration Window: You must notify us in writing of any fit concern within 14 days of delivery and ship the suit to us (or an approved service center) within 30 days of delivery.
- Scope: Alterations cover adjustments to achieve the intended fit based on the final approved measurements and design. Alterations do not include design changes, material substitutions, or wear-and-tear repairs.
- Shipping: Customer is responsible for shipping to our facility; we cover the return shipping on approved alterations.
- Remakes: Full remakes are at our discretion and only if alterations cannot reasonably achieve the intended fit.
3) Measurement Responsibility
By placing an order, you confirm the measurements you submit (or approve) are accurate. If measurements were taken by you or a third party not authorized by [Company Name], [Company Name] is not responsible for inaccuracies arising from those measurements. If our authorized fitter measured you and we manufactured to those measurements, alterations (per Section 2) are your exclusive remedy.
4) Non-Resalable, Personal-Use Product
Custom-measured race suits are personalized, hygiene-sensitive, and safety equipment tailored solely for the original purchaser. Similar to other intimate or personal-use goods, they cannot be resold or reused by others and have no general resale value. They are intended only for the original purchaser’s personal use.
5) Acceptance on Delivery; Evidence of Conformance
Upon delivery, you agree to inspect the suit within 14 days. Absent timely written notice of a fit or manufacturing issue, the suit is deemed accepted. We may document conformance to your order (e.g., photos, work orders, measurement sheets, QC logs).
6) Chargebacks / Payment Disputes
You acknowledge and agree that this order is for custom-made goods and that alterations are your exclusive remedy for fit concerns.
- You agree not to initiate a payment dispute or chargeback for reasons related to fit, preferences, or other issues covered by our alterations policy.
- If you believe a charge was unauthorized or fraudulent, contact us immediately; we will investigate.
- Nothing in these Terms limits any non-waivable rights under applicable law; however, you agree to first allow us to resolve fit concerns via alterations before pursuing any payment dispute.
- If a chargeback is initiated contrary to these Terms and we prevail, you agree to reimburse our reasonable dispute fees, return shipping, and administrative costs.
7) Limitation of Liability
To the fullest extent permitted by law, our liability for any claim relating to a custom suit is limited to the cost of alterations under Section 2. We are not liable for consequential or incidental damages (e.g., missed events, race fees, or indirect losses).
8) Safety & Intended Use
Custom race suits are protective garments designed for motorcycle track use by the original purchaser. You understand and accept the inherent risks of riding and racing; no suit can prevent all injury.
9) Governing Law; Informal Resolution → Mediation → Binding Arbitration
Before any formal action, the parties will attempt in good faith to resolve any dispute informally. If unresolved after 30 days, the parties shall submit the dispute to non-binding mediation in [County, State]. If mediation fails, the dispute shall be resolved by confidential, binding arbitration in [County, State] under the rules selected by the arbitrator. If the parties cannot agree on an arbitrator, the state court may appoint one. Each party bears its own fees unless the arbitrator awards otherwise. No class or collective actions. Judgment may be entered on the award in any court of competent jurisdiction.
10) Severability; Non-Waiver
If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of that provision.
